Please read these terms carefully before using MyKioku.
1. Individual Operation & Service Provider
MyKioku is a service owned and operated by an individual ('the Developer'). By using this service, you acknowledge that you are interacting with an individual operator and not a corporate entity.
2. 'As Is' Service & No Warranties
The service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, the Developer provides no warranties, express or implied, including but not limited to the merchantability, fitness for a particular purpose, or non-infringement of the service. There is no guarantee of continuous, uninterrupted, or secure access to the service.
3. AI Accuracy & User Responsibility
MyKioku utilizes Artificial Intelligence to process information. AI is inherently imperfect and can generate factually incorrect, biased, or incomplete information ('hallucinations'). You are solely responsible for verifying all AI-generated content (including flashcards, summaries, and health/legal insights) against official and authoritative sources before use or reliance. The Developer is not responsible for any inaccuracies.
4. Limitation of Liability
To the maximum extent permitted by law (including Australian Consumer Law), the Developer shall not be liable for any direct, indirect, incidental, or consequential damages (including loss of data, profits, professional standing, or failed exam results) arising from your use or inability to use the service, even if advised of the possibility of such damages.
5. Indemnification
You agree to indemnify and hold the Developer harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of MyKioku, your violation of these terms, or your infringement of any third-party rights.
6. Governing Law
These terms are governed by and construed in accordance with the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any disputes.
